Ind. Decisions - New Albany mayor vetoes sewer ruling
Updating this ILB entry from yesterday, Dick Kaukas of the Louisville Courier Journal reports today:
Less than 24 hours after the New Albany City Council voted to file lawsuits to challenge the validity of two no-bid contracts, Mayor James Garner vetoed the resolution.Garner announced his decision yesterday at a meeting of the city sewer board, of which he is chairman, saying that bids aren't required for "professional service contracts" and that the litigation "will result in a wasting of taxpayer and/or utility funds" on legal fees.
Councilman Dan Coffey, who led the effort to go to court, said last night that he was "flabbergasted " by Garner's veto.
Coffey said he knew the mayor could veto ordinances but it wasn't clear whether he could veto resolutions. Coffey said he would seek legal advice and, if told the veto was proper, will ask for a special council meeting to try to override it.
That would require six of the council's nine votes. The council had voted 5-3 Monday night to sue, with one abstention.
