Ind. Decisions - Upcoming oral arguments this week

This Thursday, Jan.. 3rd:

9:00 AM - Tonda Nichols v. Rex Minnick - In this action by a seller to recover a commission she had paid to a broker, the trial court entered judgment for the broker. The Court of Appeals affirmed in an unpublished memorandum decision, holding the broker's failure to disclose to the seller that he lent money to the buyer to complete the transaction was not a serious breach of his duty to the seller. Nichols v. Minnick, 53A01-0606-CV-268 (Ind. Ct. App. April 13, 2007), vacated. [See ILB entry here - 5th case] The Supreme Court has granted a petition to transfer the case and has assumed jurisdiction over the appeal. 9:45 AM - Dawn E. McDowell v. State - Over McDowell's objection, the Howard Circuit Court gave a jury instruction regarding intent to kill. The jury found McDowell guilty of voluntary manslaughter, and she was sentenced to forty years. The Court of Appeals affirmed the conviction and sentence in McDowell v. State, 872 N.E.2d 689 (Ind. Ct. App. Aug. 31, 2007), vacated. [See ILB entry here - 5th case] The Supreme Court has granted a petition to transfer the case and has assumed jurisdiction over the appeal.
