Ind. Decisions - Three transfers granted today [Updated]

The transfer list will not be available until Monday, April 6th, but the ILB has received notice of three transfers granted today by the Supreme Court. Here is the list:

Cornelius Cooper v. State -- 49A02-0709-CR-780 -- 4/2/09 - probation revocation - see ILB summary of Oct. 6, 2008 COA opinion here, 2nd case.

In re Paternity of N.L.P. -- 45A03-0805-JV-226 -- 4/2/09 - "Swope raises the following restated issue: whether the trial court erred when it failed to award her total fees and expenses incurred while serving as GAL." - see ILB summary of Dec. 23, 2008 COA opinion here - 4th case.

Clay City Consol. Sch. Corp. v. Timberman -- 11A04-0802-CV-96 -- 4/2/09 - "For the foregoing reasons, we conclude that the trial court committed reversible error when instructing the jury that Indiana law contains a rebuttable presumption that children between the age of seven and fourteen cannot be contributorily negligent. Therefore we must reverse and remand for further proceedings consistent with this opinion." - see ILB summary of Dec. 2, 2008 COA opinion here, 2nd case.
