Ind. Decisions - Three cases granted transfer June 16th
The Clerk's transfer list should be available sometime Monday. Meanwhile, the ILB has received notice that transfer was been granted June 16th in three cases. Links below are to COA opinions:
- Julie Gardiner v. State -- 08A02-0810-CR-874 - Here is the March 31st ILB summary of the 2-1 opinion (4th case) - a quote from the opinion: "No Indiana court has addressed the issue of whether a reduction of a prior conviction from a felony to a misdemeanor pursuant to the terms of a plea agreement affects the application of the non-suspension rule in Indiana Code section 35-50-2-2(b)(1)."
- Jimmie Smith v. Champion Trucking Co., Inc. -- 93A02-0808-EX-701 - Here is the Feb. 25th ILB summary (2nd case) - a quote from the opinion: "The sole issue presented is whether Smith’s worker’s compensation application was properly dismissed pursuant to the subrogation portion of the Indiana Worker’s Compensation Act (“the Act”), Indiana Code Section 22-3-2-13, after Smith settled his claim against a third-party tortfeasor."
- Eric Sibbing v. Amanda Cave -- 49A02-0802-CV-165 - Here is the March 5th ILB summary of the 2-1 opinion - a quote from the opinion: "On appeal, Sibbing presents two issues: (1) whether the trial court erred in allowing into evidence testimony from Cave regarding medical test results and the cause of her pain, and (2) whether the trial court erred in granting Cave's motion to strike portions of the testimony of Sibbing's expert medical witness."
