Ind. Decisions - "Marion County Judge allows lawsuit in Pan Am Plaza sale"
A brief story today in the Indianapolis Star:
A Marion Superior Court ruling has allowed a taxpayers' lawsuit to proceed in a challenge of the sale of Pan Am Plaza in Downtown Indianapolis.The plaintiffs contend Indiana Sports Corp. should have paid $6 million to the city when it sold the lot in April 2008 to a developer, based on a 1985 redevelopment agreement requiring the agency to maintain the plaza as an outdoor, public space.
AdvertisementIn December 2007, the city's Metropolitan Development Commission amended the 1985 agreement to authorize private redevelopment and reduce the amount of space that must be set aside for the public to 10,000 square feet.
Judge Heather Welch on Monday allowed the suit to proceed by denying a motion by the city and the Sports Corp. for a judgment on the pleadings. The ruling says the plaintiffs have standing to sue and says disputes of material facts exist on multiple issues.
