Ind. Decisions - Transfer list for week ending May 6, 2011
Here is the Clerk's transfer list for the week ending May 6, 2011. It is two pages (and 20 cases) long.
Two petitions to transfer were granted:
- Joey Addison v. State of Indiana - a Feb. 16, 2011 NFP COA opinion, that concluded: "It is well-settled that where improperly excluded testimony is merely cumulative of other evidence presented, its exclusion is harmless error. ... As evidenced by the verdict of guilty but mentally ill, the jury heard considerable evidence that Addison had significant mental health issues that may have contributed to or influenced his actions in the instant killing. We cannot say that he suffered prejudice to his substantial rights from the trial court's improper exclusion of Lola's deposition testimony at trial. Thus, we find no reversible error."
- Amir H. Sanjari v. State of Indiana - a Feb. 11, 2011 COA opinion. Transfer was granted to the Appellee, and denied to the Appellant. The COA concluded its opinion: "In sum, we conclude that the trial court acted within its discretion in determining that Sanjari had waived his right to be present at trial and in denying his October 29, 2009 motion for continuance. We vacate his conviction and sentence on Count II due to double jeopardy constraints and affirm his conviction and five-year sentence on Count I, with fines, costs, and restitution."
