Ind. Decisions - Transfer list for week ending April 19, 2013

Here is the Clerk's transfer list for the week ending Friday, April 19, 2013. It is two pages (and 24 cases) long.
Two transfers were granted last week:
- David Delagrange v. State of Indiana - This was a 2-1 Jan. 25, 2013 COA opinion (ILB summary here) where the majority wrote: "Due process prohibits Delagrange’s convictions under the statutes that existed at the time of his actions, though it appears similar acts in the future could be punished as public voyeurism. As the statutes in force when Delagrange committed his acts required conduct by the child, we are compelled to reverse his convictions and remand, as there was no evidence any of the minors were involved in the type of conduct required by the child exploitation statute."
- Erving Sanders v. State of Indiana - This is a Jan. 22, 2013 COA opinion (ILB summary here) that concluded: "Based upon the evidence presented at the suppression hearings, including the photographs of the Suburban which were taken one hour after the stop and depict the window tinting, we cannot say that there was an objectively justifiable reason for the stop of the vehicle. Accordingly, under the totality of the circumstances Officer Minch lacked reasonable suspicion to stop Sanders for investigatory purposes at the time he observed Sanders’s vehicle. The trial court erred in denying Sanders’s motion to suppress."
