Ind. Decisions - Transfer list for week ending September 18, 2015
Here is the Clerk's transfer list for the week ending Friday, September 18, 2015. It is two pages (and 24 cases) long.
Four transfers were granted last week:
- Two of the transfers were in the cases of Anthony P. Sharp, Jr. v. State of Indiana and Blake Layman & Levi Sparks v. State of Indiana, the "Elkhart 4" cases, where transfer was granted, with opinion, on Sept. 18.
- State of Indiana v. Brian J. Taylor - this was a 2-1, June 10th opinion involving this issue:
... whether the trial court properly excluded all testimony of police officers that asserted their Fifth Amendment right to remain silent during depositions and testimony at the suppression hearing.
- Ashonta Kenya Jackson v. State of Indiana - this was a 2-1 June 4th opinion (2nd case) involving, inter alia, a question of statutory interpretation. From the majority:
While Indiana’s statute for corrupt business influence does not expressly include an element of continuing the criminal conduct into the future, the statute is patterned after the federal RICO statute, and we look to relevant federal case law for guidance in interpreting the Indiana version of the statute.
