Ind. Decisions - Transfer list for week ending November 27, 2015
Here is the Clerk's transfer list for the week ending Friday, November 27, 2015. It is two pages (and 26 cases) long.
Two transfers were granted last week:
- Newland McElfresh v. State of Indiana - This was an August 7th COA opinion, invoking a no contact order and violation of privacy charges.
- Andy Mohr West, et al. v. IN. Secretary of State, et al. - Transfer was granted to both Appellee - Toyota Motor Sales, U.S.A., Inc. and Appellee - Secretary of State. This was an August. 13th 2-1 opinion presenting a question of first impression regarding an interpretation of the Indiana Dealer Services statutes.
- A.R. v. Review Board - All Justices concur, except Rush, C.J., and Rucker, J., who vote to grant the petition to transfer. 8/7/15 NFP
- Robert Shelley v. State of Indiana - All Justices concur, except Rucker and David, JJ., who vote to grant the petition to transfer. 8/28/15 NFP, involving a claim of a statutory exception in the firearms law. From the COA opinion:
Shelley was convicted of carrying a handgun without a license pursuant to Indiana Code Section 35-47-2-1. * * *
Shelley contends that his conviction should be overturned pursuant to subparagraph (b)(2)(A) of the statute because he carried the handgun on Coe’s property with Coe’s consent. The State contends that this provision is irrelevant because the evidence and reasonable inferences most favorable to the trial court’s judgment indicate that Shelley carried a loaded handgun to Coe’s house without a license in violation of subparagraph (b)(3)(A). We agree with the State.
