Ind. Decisions - Transfer list for week ending July 1, 2016
Here is the Clerk's transfer list for the week ending Friday, July 1, 2016. It is one page (and 12 cases) long. All three trasnfers were decided by the COA on March 15, 2016.
Three transfers were granted last week:
- ESPN, Inc., et al. v. University of Notre Dame Police Department - this was the March 15, 2016 COA opinion concluding that the Notre Dame Police Department does qualify as a “public agency” under APRA. See also this May 11, 2016 ILB post.
- Michael Day v. State of Indiana - this was a 2-1, March 15, 2016 NFP COA opinion. From the majority opinion:
Day contends the evidence is insufficient to support his conviction for disorderly conduct because the State failed to prove Day disrupted the public. Day claims the legislature, in enacting Indiana’s disorderly conduct statute, intended to require a component of disrupting the public before one can be convicted of disorderly conduct. We disagree.From the dissent:
I simply cannot believe that a verbal argument between members of a household, within their own home, can be the sole basis of a criminal conviction for disorderly conduct.
- Demajio Ellis v. State of Indiana - this was (also) a March 15, 2016 NFP COA opinion, where the issue was:
... whether Ellis consistently denied culpability for the crimes to which he plead guilty, undermining the reliability of his plea and requiring the post-conviction court to vacate it as a matter of law.
