Ind. Decisions - More on: COA decides Pence email case, Groth v. Pence
The ILB has had a number of posts on Groth v. Pence, the email public records challenge.
Today the Court of Appeals issued its opinion.
In answer to an ILB question, William R. Groth, plaintiff in the case, replies:
Two principal observations. The COA completely rejected Pence’s contention that CAC v. Koch shields his emails or makes non-justiciable claims like this under APRA. [ILB - see opinion, beginning on p. 15] Second, today’s decision revealed a sharp split in the panel over the application of the common interest privilege to the Texas AG’s “white paper.”Groth adds that no decision has been made yet on a petition for transfer.
